Conditions for publishing reviews

TROPHY offers the possibility to leave reviews on its website accessible at bering-moto.com .

Posting a review on the Site implies acceptance of and compliance with these posting conditions (hereinafter the "Publication Conditions"). TROPHY reserves the right to modify them at any time. If so, we will inform you by changing the date at the bottom of these Publication Conditions and, in some cases, we will provide additional notifications (for example, by posting a statement on the home pages of our Site or by sending you an email).

ARTICLE 1 - PURPOSE OF THE SITE NOTICE FUNCTIONALITY

1.1 The review feature allows its users to leave reviews, advice, tips, suggestions, information, recommendations on products marketed by TROPHY and to assign them a rating that can vary from one star (for "Bad") to five stars (for "Excellent").

1.2 TROPHY provides users (hereinafter referred to as the "User(s)") with a space to store only their opinions for the purpose of their dissemination on all current and future public communication media of TROPHY, including but not limited to electronic communication services (including the merchant sites of the 2ride Group and/or any possible variation on mobile devices) and marketing and/or advertising communication media (emailing, mailing, advertising banners on the Internet, promotional materials in TROPHY stores, etc.) published by TROPHY.

ARTICLE 2 - FILING, BADGES AND CLASSIFICATION OF NOTICES

2.1 All users of the TROPHY review feature must accept the Publication Terms. TROPHY may request proof of parental/guardian status from any minor user and, failing that, refuse to publish a review.

2.2 Users have the option to submit their reviews according to the following procedures:

  • Users submit reviews spontaneously, on their own initiative, by clicking "Leave a review" on the relevant product page. In such cases, TROPHY cannot confirm that the user is submitting a review for a product they have actually purchased or tested. This includes reviews without any specific badge or label, as well as those marked with a "spontaneous review" badge.
  • following the receipt of an email inviting them to give their opinion on a product they purchased from TROPHY. These opinions, solicited by TROPHY following a purchase, are identified on the Site by a "verified buyer" badge.

2.3 Reviews are displayed by default in chronological order, from newest to oldest, but users can choose to display them according to other criteria such as usefulness or rating.

ARTICLE 3 - CONTENT OF REVIEWS / USER RESPONSIBILITIES

3.1 A review must include a username, an evaluation, a title and a description of at least 50 characters.

3.2 The review feature may not be used to disseminate content that violates public decency, public order, the rights of others, or applicable laws and regulations, including but not limited to:
statements or messages that are defamatory, abusive, obscene, racist, offensive, or that mention illegal activities in any form;

  • Any abuse in the exercise of freedom of expression, such as statements consisting of systematic or biased criticism, as well as statements of a denigrating or malicious nature
  • Content that is violent, pornographic, or likely to infringe upon respect for human dignity, equality between women and men, or the protection of children and adolescents
  • statements or messages inciting the commission of crimes and offenses, violence, discrimination or racial hatred
  • the usurpation of a name, email address or company name
  • the total or partial reproduction of content protected by intellectual property rights and for which Users do not have rights, as well as messages constituting trademark infringement.

3.3 Users are prohibited from misusing the review functionality for propaganda, prospecting, soliciting or proselytizing, for professional, commercial or political purposes (advertising, "spam" content or references to other products, commercial of.comes or websites…).

3.4 Notices must not contain, in particular:

  • email addresses, URLs, telephone numbers, postal addresses or other information (name, surname, etc.) that could identify the User or a third party
  • critical comments on other reviews published on the Site or on their authors
  • comments on the medical effectiveness of the products.
  • comments relating to another product or to problems encountered during orders (delivery problem…).
  • of comments encouraging purchases from a TROPHY competitor.

3.5 The content of the reviews must not be contrary to these Publication Conditions.

3.6 Users are also prohibited from hindering or disrupting the operation of the TROPHY review functionality.

Users are prohibited from incorporating documents or software into the reviews posted in the storage space provided by TROPHY that could damage the computers of other users or that could allow unjustified access to other websites.

Users are responsible for taking all appropriate measures regarding the equipment they use to protect said equipment from potential contamination by viruses or intrusion attempts. Equipment includes, but is not limited to: personal computers, personal digital assistants (PDAs), internet access, software programs, and data.

3.7 Users are solely responsible for all content they transmit via the TROPHY review feature.

ARTICLE 4 – MODERATION AND PUBLICATION OF REVIEWS

4.1 Reviews and their accompanying usernames are systematically moderated by software based on keywords predefined by TROPHY and, in some cases, reviewed by moderators before being published on the Site. TROPHY reserves the right not to publish any review that violates the provisions set forth in these Publication Terms. If applicable, the User will be notified by email.

TROPHY does not edit reviews but may correct minor spelling or typing errors without changing the meaning of the submitted review. Furthermore, TROPHY also reserves the right to remove any review that does not comply with the Terms of Use at any time.

Once submitted, a review can no longer be modified by the User.

4.2 Reviews are published on average within two to four working days of being sent by the User, subject to compliance with the Publication Conditions.

The User will receive an email confirming the publication of their review or, failing that, informing them of its rejection. Any subsequent use of the review under the conditions set out in Article 1.2 above will not result in a new email being sent.

4.3 Once a review is published on the Site, users have the option, via a provided link, to indicate whether they found it helpful or not, and to report any content they deem inappropriate. TROPHY will review these reports and may remove any review that does not comply with these terms.

4.4 Reviews are published on the Site for a maximum period of 10 years. They may be removed by TROPHY before this expiry date if they relate to a product that is no longer marketed by TROPHY or whose characteristics have changed so drastically that they render the reviews irrelevant.

ARTICLE 5 - INTELLECTUAL PROPERTY

5.1 TROPHY owns all intellectual property rights to both the structure and content of the Site's review feature (including, but not limited to: text, logos, images, illustrations, photographs, videos, graphic or audio elements, music, icons, layout, graphic charter, software, databases, etc.) or has duly acquired the rights/authorizations allowing their use. All trademarks and/or logos reproduced on TROPHY's review feature are the exclusive property of either TROPHY or its service providers, partners, or suppliers.

Any use of these elements, in any manner and for any purpose whatsoever, other than the use strictly necessary for the dissemination of the User's opinion as defined herein, is prohibited unless expressly authorized in writing in advance by TROPHY or the holder of the intellectual property rights concerned.

In general, the User is prohibited from infringing upon the intellectual property rights (copyright, related rights, sui generis database producer rights, trademark rights, domain names, etc.) of TROPHY, the companies of the 2ride group, and/or any third party. Any unauthorized or abusive use of intellectual property rights may result in TROPHY or any other relevant third party taking any appropriate action or sanction.

5.2 By submitting their opinion on the Site, Users expressly and freely consent to TROPHY disseminating, reproducing and representing all or part of their opinion as well as their pseudonym by any means of reproduction and representation and on all media worldwide and for a period of 10 years.

The media used may include graphic and paper media, audiovisual, computer and digital communication media such as CD-ROM, DVD, electronic communication services (including the 2ride Group's merchant sites and/or any possible variation on mobile devices) and marketing and/or advertising communication media (emailing, mailing, advertising banners on the Internet, promotional materials in TROPHY stores, etc.) published by TROPHY, and all media known or to be discovered in the future.

This authorization includes, in particular, the possibility for TROPHY to freely and without charge use all or part of the opinions and pseudonyms, to reproduce them, delete them in whole or in part, adapt them, publish them, translate them, create derivative works, sell them, distribute them in particular for commercial, promotional and advertising purposes.

ARTICLE 6 - PERSONAL DATA

As part of the review functionality, TROPHY collects personal information (including email, username, city, age range, gender, skin type, eye color) from Users who post a review on the Site.

Only fields marked with an asterisk on the feedback form are mandatory to leave a review on the Site. Otherwise, the User will not be able to submit their review.

Users are informed that all or part of their personal data thus collected by TROPHY may be used by the latter, and where applicable by its service providers, for the dissemination of the opinion on current and future public communication media of TROPHY, including and without limitation electronic communication services (in particular the merchant sites of the 2ride Group or any possible variation on any mobile device) and/or marketing and/or advertising communication media (emailing, mailing, advertising banners on the Internet, promotional materials …) published by TROPHY.

The personal data that will be used for this dissemination may include: username, city, age range and gender.

In order to comply with its legal obligations, TROPHY may also collect and store data that could allow the identification of anyone who has contributed to the creation of online content.
